At Motion Mindset Chiropractic and Wellness, we are committed to protecting your privacy and keeping your personal health information confidential.

Your health information is personal to you and is sensitive. It tells part of your story, and we handle it with care, respect, and use appropriate safeguards. When we collect, use, store, or share your information, we take proactive steps to keep it private and secure.

You have the right to know how we collect, use, and disclose your personal health information. You may ask to see or correct your health record, ask questions about our privacy practices, or withdraw your consent.

Who is responsible for protecting your information?

Ontario's Personal Health Information Protection Act, 2004 (PHIPA) sets the rules for how personal health information is collected, used, stored, and shared.

Dr. Jesse Humphries is the Health Information Custodian for Motion Mindset Chiropractic and Wellness. This means he is responsible for making sure your personal health information is handled in a way that protects your privacy and confidentiality.

Anyone who works with or supports the clinic, including staff, volunteers, contractors, or other service providers, must also protect your personal health information. These individuals may act as "agents" under PHIPA and are expected to follow the clinic's privacy policies and confidentiality requirements.

What information we collect

We may collect information about you such as:

• Your name, date of birth, address, contact information, and emergency contact
• Your health history, symptoms, assessment findings, treatment notes, and care plan
• Appointment, billing, insurance, and payment information
• Reports or information from other health care providers, when relevant to your care
• Information needed for referrals, forms, reports, or communication with your health care team

We only collect personal health information that is necessary to provide health services to you.

How we use your information

We use your personal health information to:

• Provide chiropractic care, rehabilitation, assessments, treatment, and follow-up
• Create and maintain an accurate health record for you
• Book appointments and send you appointment reminders
• Communicate with you about your care
• Bill you or your insurer and process direct billing, claims, and payments
• Make referrals or share information with other healthcare providers involved in your care
• Improve the quality of our services

When we disclose your information

We will ask for your consent before sharing your health information, unless the Personal Health Information Protection Act (PHIPA) allows or requires us to share it without consent.

We may share your health information:

• With your consent, such as when sending information to your insurance company or benefits provider for billing, claims, or payment purposes

• With health care providers directly involved in your care, such as your family doctor, physiotherapist, specialist, or another provider within your circle of care. In these situations, we may rely on your implied consent when the information is needed to support your care.

• When required or permitted by law, such as responding to a legal requirement, reporting certain public health concerns, or acting when there is a significant risk of serious harm.

Consent and your choices

In many cases, we rely on your implied consent to collect, use, and share your personal health information for the purpose of providing health care within your circle of care.

We will always ask for your express consent when required, such as before sending information to someone who is not involved in your care, including a lawyer, employer, insurer, school, or other third party, unless the law allows or requires us to share it without consent.

You may ask us not to share certain parts of your health record with specific people or providers. Please tell us if you have a privacy preference or restriction. We will explain what we can do and whether any legal or safety exceptions apply.

Email, phone, and text communication

We may contact you by phone, voicemail message, email, or text for appointment booking, reminders, clinic communication, billing, or care-related follow-up.

Email and text messaging may not be as secure as other forms of communication. Please tell us if you prefer not to be contacted in a certain way.

How we protect your information

We take reasonable steps to protect your personal health information from theft, loss, unauthorized access, copying, use, disclosure, or disposal.

These safeguards include:

• Using secure electronic health record and booking systems
• Limiting access to personal health information to only those who need it for their role
• Using strong passwords, multifactor authentication, and other technical safeguards
• Keeping any paper records secure
• Requiring all clinic staff to complete privacy training and sign a confidentiality agreement
• Training team members on their privacy responsibilities
• Reviewing and updating our privacy practices regularly

Your rights

You have the right to:

• Ask to see or receive a copy of your health record, subject to limited legal exceptions
• Ask us to correct information in your health record if you believe it is inaccurate or incomplete
• Ask questions about how your personal health information is collected, used, stored, or shared
• Raise a privacy concern or complaint with us
• Make a complaint to the Office of the Information and Privacy Commissioner of Ontario

If, after contacting us, you continue to have a concern about how your personal health information has been handled, you have a right to contact the Office of the Information and Privacy Commissioner of Ontario.
